1. Acceptance of Terms

ProWiderKart (prowiderkart.com) ki service access ya use karke, aap acknowledge karte hain ki aapne ye Terms of Service ("Terms") padhe, samjhe, aur bound hone ke liye agree kiya. Agar agree nahi karte to please service use na karein.

2. Nature of Service — Facilitator Only

ProWiderKart ek financial facilitation platform hai. Hum users aur businesses ko RBI-registered lenders, IRDAI-registered insurers, aur authorized payment aggregators ("Partners") ke saath connect karte hain.

Hum explicitly NOT hain:

• A lender ya non-banking financial company (NBFC)
• An insurer, insurance broker, ya insurance web aggregator
• A payment aggregator ya payment system operator (PSO)
• A recruitment agency, employer, ya guaranteed-income provider
• A SEBI-registered investment advisor

Sab financial products, services, approvals, terms, interest rates, premiums, fees, aur decisions solely Partners ke through determined hote hain unki internal policies aur applicable regulations ke according. ProWiderKart underwriting, approval, ya pricing decisions NAHI leta.

3. Eligibility

Aap honge:

• Minimum 18 years of age
• Sound mind aur legally competent contracts enter karne ke liye Indian law ke under
• Accurate, complete, aur current information provide karne ke liye willing

Service use karke aap represent karte hain ki aap ye criteria meet karte hain.

4. No Guarantee

ProWiderKart explicitly guarantee NAHI karta:

• Kisi loan, insurance policy, ya service ka approval
• Specific interest rates, premiums, ya terms
• Partner program me specific commission earnings ya income
• Continuous, uninterrupted, ya error-free service availability
• Partner interactions ke outcomes

Koi bhi earnings ya product information shown illustrative hai. Actual results depend on individual circumstances, partner policies, aur external factors.

5. Partner / DSA / Referral Program

Agar aap hamare partner/DSA/referral program join karte hain:

• Aap independent facilitator ke roop me operate karte hain, ProWiderKart ke employee/agent nahi
• Commission, agar koi ho, variable hai aur depend karta hai on partner agreements aur aapki activity pe
• Hum monthly income, lead volume, ya conversion rates ki guarantee NAHI dete
• Partner program join karne ke liye aap se KOI joining fee ya membership fee nahi liya jata. Hum aapko commission/revenue-share opportunity provide karte hain
• Aap agree karte hain RBI Digital Lending Guidelines, IRDAI norms, aur consumer protection laws comply karne ke liye
• Aap agree karte hain NOT to make false claims, approvals guarantee karna, ya partner products misrepresent karna

6. User Obligations

Aap agree karte hain:

1. Sab enquiries me accurate, truthful information provide karna
2. Service sirf lawful purposes ke liye use karna
3. Misuse, hack, scrape, ya unauthorized access attempt NAHI karna
4. Kisi person ya entity ko impersonate NAHI karna
5. Harmful code, spam, ya unsolicited communications transmit NAHI karna
6. Sab applicable laws comply karna

7. Intellectual Property

Service pe all content — text, graphics, logos, images, software, aur design — ProWiderKart ya hamare content suppliers ki property hai aur Indian aur international copyright laws ke under protected hai.

Aap copy, reproduce, distribute, ya derivative works hamari written consent ke bina nahi bana sakte. "ProWiderKart" mark aur hamara logo hamare trademarks hain (ya pending registration).

8. Limitation of Liability

Maximum extent permitted by law ke under:

• ProWiderKart liable NAHI hoga any indirect, incidental, consequential, special, ya punitive damages ke liye
• Service ke baare me arising total aggregate liability INR 1,000 se exceed nahi karegi
• Hum responsible NAHI hain Partners ke actions, decisions, products, services, ya omissions ke liye
• Hum liable NAHI hain delays ya failures ke liye reasonable control ke bahar (force majeure, regulatory action, technical failures)

9. Indemnification

Aap agree karte hain ProWiderKart, uske operators, employees, aur partners ko indemnify aur hold harmless karne ke liye against any claims, damages, losses, liabilities, costs, aur expenses (reasonable attorneys' fees including) arising from:

• Aapke service use ya misuse
• Inn Terms ka violation
• Kisi third-party right ka violation
• Aapki false ya misleading information

10. Third-Party Links and Partners

Hamari service me partner websites aur third-party services ke links hain. Hum content, privacy practices, ya in third parties ke actions ko control, endorse, ya unke liye responsibility assume nahi karte. Partners ke saath aapke interactions unki apni terms aur policies se governed hain.

11. Modification of Service

Hum right reserve karte hain service ke kisi bhi part ko modify, suspend, ya discontinue karne ka, kabhi bhi, prior notice ya liability ke bina.

12. Termination

Hum aapka service access suspend ya terminate kar sakte hain hamari sole discretion pe, notice ke bina, kisi bhi reason ke liye — Terms violation, suspected fraud, ya regulatory requirements include karke.

13. Governing Law and Jurisdiction

14. Dispute Resolution

Agar informal resolution 30 days me fail ho jaye, parties Arbitration aur Conciliation Act, 1996 ke under arbitration proceed kar sakte hain, seat Mumbai me hogi.

15. Entire Agreement

Ye Terms, Privacy Policy aur Disclaimer ke saath, aapke aur ProWiderKart ke beech service ke baare me entire agreement constitute karte hain.

16. Severability

Agar inn Terms ka koi provision unenforceable found ho jaye, baki provisions full force aur effect me continue rahenge.
